Does Your Bucket Have a Hole?

Introducing the iEngage Risk Assessment, including a unique “bucket solution”, which has been tested by a number of Business Monitor subscribers, to ensure they have all the checks in place as a result of the amendments to the Fair Work Act August 2024. Are you confident your workers are all engaged correctly? These amendments remove much of the doubt around definitions of employees, contractors, casual workers and other engagement models that have proliferated for many years as a result of lack of clarity and often inconsistent rulings.

Summary of the key changes.

As part of its 'Closing Loopholes' legislation, the Australian Government has made significant amendments to the Fair Work Act to strengthen protections for workers. Fair Work Ombudsman Anna Booth encourages all stakeholders in workplaces to fully comprehend the extent and timing of these adjustments before they're directly impacted.

“Employers, employees and independent contractors need to understand the changes, which create new or changed responsibilities and rights in a range of areas,” Ms Booth said.

The Monitoring Moments discussion this week looked at the unique “bucket”' test we have developed for our clients to review their workforce engagement contracts and, if necessary, take steps to make changes and have discussions with all relevant parties to minimise risk of fines and more. We have not yet found a bucket that doesn’t have at least one leaky hole and, in some cases, multiple leaks. How do you think your business would fare?
