Latest changes in Labour Hire Licensing Declarations
Throughout the Labour Hire Licence application process there are important declarations that need to be made by the Nominated Person. These are legal statements and must be recognised for the implications that can occur if they are found to be misleading or in fact incorrect. Monitoring Moments team Dianne Gibert and Julie Mills recently discussed the high level implications of the changing landscape in labour licence application requirements.
Key Points
In Victoria you are now required to complete a two step factorial confirmation – online & via your phone which creates a higher level of information security.
In both Queensland and Victoria there is now a greater focus on declarations related to your personal background as well as declarations to indicate you understand the obligations you have across all areas of legislation impacting workers, in particular WHS and worker engagement.
Queensland requires evidence of sample contracts as part of the application while Victoria usually requests this and other worker engagement information as part of due diligence during the process.
There are a number of other variations which also impact the annual reporting requirements to the regulators.
Final declarations
Remember these declarations, if found to be incorrect or inconsistent, can incur heavy penalties so it is important to understand what you are declaring.
